Seven Plead Guilty in Race Fixing

Government prosecutors have agreed to accept guilty pleas from seven of nine defendants involved in race fixing at Penn National Race Course. The case stems from the fixing of fifteen races between January and May at the Grantville PA oval, in which authorities claim horse owners George D. Berryhill and Neil McElwee conspired with jockeys to hold back favored horses. Jockey Ramon Pena was the middleman between the jockeys and the owners.

Federal Prosecutor David M. Barasch indicated that the the two horse owners and the five jockeys who pled guilty to charges of conspiracy to fix a sporting event may face up to five years in prison and fines of a quarter million dollars each. Jockey Felix Pinero, also indicted in the scheme, has pled innocent and awaits trial. Jockey Manuel F. Torres failed to appear in Court and an outstanding warrant for his arrest has been issued.

The Penn National oval is owned by Penn National Gaming Inc., whose holdings include Mississippi casinos at Bay St. Louis and Biloxi; two race tracks in Pennsylvania, one track in West Virginia, 11 Off Track Wagering facilities, and is in the process of acquiring CRC Holdings Inc. (Carnival Resorts and Casinos)
